Online Traffic Safety - New York Pre-Licensing Course

Terms and Conditions

Online Traffic Safety, hereafter referred to as the Course provider, agrees to provide the applicant, hereinafter referred to as the “Student,” 270 minutes of online classroom instruction for the New York Online Pre-Licensing course as specified by the New York Department of Motor Vehicles (DMV). The Student is required to complete all 270 minutes of instruction and pass all lesson quizzes to qualify for completion. Online Traffic Safety shall furnish a copy of an enrollment contract immediately upon Student’s acceptance and will submit Student’s completion information to the New York DMV when Student completes the course. Online Traffic Safety will also email Student’s Notification of Completion to Student upon Student’s completion of the course. Please Note: The Pre-Licensing course is designed to provide information necessary for safe driving. It is not to help prospective drivers pass the road test.

Hardware / Software Requirements

In order to access and complete this Course, you must satisfy the following computer hardware and software requirements: access to the Internet; an email account and related software capable of receiving email through the Internet; a web browser which is SSL-compliant and supports secure sessions; and hardware capable of running this software. You will also need a printer if you wish to print electronic documents on paper, and electronic storage if you wish to download and save documents to your computer.

Age Restrictions

Persons under the age of 18 should use this website only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult. You will not be permitted to take this Course if you are under the age of 18 and applying for a Junior License. Your date of birth as it appears on your permit will be validated.

Permit Requirements

Each student must possess a valid New York State Leaners permit. You must not be applying for a class DJ or class MJ license to take this course. If you can not provide this information, you will not be permitted to take this course.

Course Schedule

The course will be available to the Student 24 hours a day, 7 days a week. This availability may be affected by circumstances such as, but not limited to: system, site or connectivity failure over which the Course Provider has no control.

Lesson Quizzes / Content Validation

Three multiple-choice quiz questions will be asked at the end of every module. Each question will have a 1-minute time limit. The Student must answer all three of the quiz questions correctly within the time limit to proceed to the next lesson. If Student does not answer all three of the quiz questions correctly (and within the time limit), Student will fail the lesson quiz. The Student has 3 attempts to pass each module quiz. If the Student fails their third quiz attempt, the New York State DMV requires that the Student restart the course.

Course Time Requirements

New York State Vehicle and Traffic Law requires that Students fulfill a minimum time requirement of 270 (two hundred seventy) minutes of active interactive instruction in the Course. The Course will calculate your active interaction instruction time to ensure that the minimum has been met. The minimum 270 (two hundred seventy) minutes shall not count toward the time spent on log-on procedures, administrative tasks, help functions, validation processes, download times, or reading and responding to content questions. Students that have not met the 270 minute minimum will not be issued a Course Completion Confirmation. The Course will include built-in timers to calculate time. The timers will also serve to prevent the Student from advancing to the next section in less than the amount of time it would take the average person to complete that section. The Student Must Complete the Course within 30 Days of Registration. The New York DMV requires that the Student complete the course within 30 days of registration. If Student does not complete the course within 30 days, Student must start the course over from the beginning. The Student will be subject to paying the course fee again, if the course is expired.

Final Exam

There is no final exam.

Validation Methods

Online Traffic Safety is required by the State of New York to verify Student’s identity while Student is taking the course. Online Traffic Safety uses two methods for validating Student’s personal identity:

Personal Questions: Every time Student logs into the course, Student will be asked a personal validation question. Personal Questions may be asked throughout the course as well. The Student must answer the personal validation question correctly within 45 seconds to pass the validation and continue on with the course. If Student does not answer the question correctly or if Student does not answer the question within 45 seconds, the question is counted as incorrect. The Student has three (3) attempts to answer each personal question correctly. If Student does not answer the question correctly within those 3 attempts or within the required 45 seconds (per question), then Student will be locked out of the course and prompted to contact Customer Service. If Customer Service is able to successfully identify Student, then the New York DMV requires that Student must restart the course from the beginning.

Keystroke Analysis: There will be keystroke analysis/typing verification checkpoints upon logging in and throughout the course. The Student must pass the typing verification correctly in order to proceed. The Student has three (3) attempts to pass each typing verification. If Student does not pass on Student’s third attempt, Student will be prompted to contact Customer Service. Online Traffic Safety’s Customer Service Representative will verify the Student’s identity. The New York DMV requires that the Student restarts the course, at this point.

Keystroke Analysis / Typing Verification is able to confirm the Student identity because each individual has a unique typing pattern based on the timings and durations of various key press events. We are able to use typing keystroke and biometrics analysis to store a baseline typing pattern that we then use to match new typing patterns and verify your identity. Students will not be able to continue the course until they pass each Typing Verification checkpoint. Due to DMV standards, failing three consecutive typing checkpoints will exclude you from the course. If this occurs, please contact us for further support.

Course Evaluation

The New York DMV requires that the Student complete a course evaluation at the end of the course. The Student must complete the course evaluation before their completion will be submitted to the New York DMV.

Course Completion

When Student completes the course (meaning Student has completed all 270 minutes of instruction time, passed all lesson quizzes, and completed the course evaluation), Online Traffic Safety will submit Student’s course completion to the New York DMV. The New York DMV will then record Student’s completion on Student’s driving record. Please note that it may take up to 24 or 48 hours for Student’s completion to record on their driving record after their course completion is submitted. Student’s course completion must show on Student’s driving record before Student can schedule their road test. Online Traffic Safety will also email the Student a Notification of Completion as soon as Student completes the course. The Student can keep this notification for their records. If Student needs a duplicate Notification of Completion, please contact Online Traffic Safety.

Duplicate Notification of Completion

Online Traffic Safety will issue a duplicate Notification of Completion free of charge.

Course Fee

A course fee of $50 will be charged to the student, via a credit or debit card. This fee includes all required instructional materials and must be paid prior to course completion. The stated fee may vary due to market conditions, but any variation will be expressly disclosed to the Student prior to course purchase.

Refund Policy

The Student may be eligible for a refund (minus a $10 fee for typing verification) if Student has not yet attempted a test or exam, requested or been issued a certificate, or completed the course. Students who meet these criteria must submit their request in writing (via e-mail) within 30 days of purchase along with proof of purchase and an explanation for the refund reason. In the event that Online Traffic Safety is unable to provide the course or any part of the course, Online Traffic Safety will issue a full refund. Refunds will not be issued for expired or completed courses.

Privacy Policy

The Course Provider collects information from its users at several different points on the website. The Course Provider will not use or sell this information to promote products or services unrelated to this course/product or in ways different from what is disclosed in the Privacy Policy. By agreeing to this Enrollment Contract, you are agreeing to the collection, use and disclosure of your personal information as described in the Privacy Policy located at www.5hourcourseonline.com/privacy-policy/

Fraudulent Activity

User Fraud: If Course Provider determines that you have engaged in any fraudulent use, or use in violation of these Terms and Conditions, in addition to its rights to recover any monies required to remedy such fraudulent use, Course Provider shall impose a fee of one hundred ($100.00) dollars for each investigation by Online Traffic Safety, LLC that results in a confirmation of such violation of these Terms and Conditions. By registering for a Online Traffic Safety User Account, you agree to all additional fees and penalties that Online Traffic Safety may impose in the event Online Traffic Safety deems your use of the Online Traffic Safety platform to be in breach of these Terms and Conditions, including without limitation the immediate termination of your Online Traffic Safety User Account.

No Illegal Uses: The Online Traffic Safety Property licensed hereunder shall not be used for any purpose not specifically contemplated by these Terms, or for any illegal purpose, or to commit or facilitate any act by any person in violation of any law or regulation, and/or any fraud against any person.

Debit/Credit Card Statements: Online Traffic Safety, Inc charges to your authorized Payment Instrument(s) may appear on your statement from the card issuing institution as “5 HOUR COURSE ONLINE*” followed by an identifier related to the location of the transaction initiation, the third-party provider of the ordered goods, or as an identifier communicated to you to reference a grouping of multiple individual Online Traffic Safety transactions. You agree not to knowingly falsely report such charges as fraudulent or unauthorized claims to your Payment Instrument issuing institution. A knowingly false report of a fraudulent or unauthorized charge shall be grounds for LevelUp, in its discretion, to cancel your User Account, and seek any other remedies available to Online Traffic Safety.

Learner Fraud: By using the Course, you agree to not cheat or have others complete your training. You agree to uphold the principles of Academic Integrity. If Online Traffic Safety determine that the student has engaged in Leaner Fraud, we may take any action such as but not limited to: legal actions, fine of $100, and revocation of Course Completion Certificate (if one was issued).

Student Acknowledgement

Typing “I Agree” is an affirmation by the Student that he or she agrees to the Terms listed. The Student must complete the entire course without assistance, abide by all terms of the course, and must not knowingly accept a course completion confirmation if the course has not been completed.

When registering for the course, Student will be asked to affirm that these terms and conditions have been made available to Student and that Student agrees to them.

This constitutes the entire agreement between Online Traffic Safety and Student and no verbal statement or promises not contained within this agreement shall bind Online Traffic Safety or Student. Any disputes under this Section shall be directed to the New York DMV.
